Sue was caught up in an off plan property investment in Spain.

Nine years ago John and I received the devastating news that our dream house at Santa Ana del Monte near Jumilla was unlikely to be built, as the developer was unable to get the finance needed to continue. Although we were obviously very disappointed, we assumed that we would get our deposit back and could look for another property. We then discovered that, as we hadn't been given a bank guarantee, we might lose our money. A buyers group was set up and we started talking to the developer about alternative plans. The court gave them time to raise the finance and we waited hopefully, believing that the best solution would be for a smaller urbanisation to be built, including our house.. Unfortunately it was not to be and Herrado del Tollo eventually went into administration.  It looked as if we might lose our deposit because we hadn't been given a bank guarantee and the developer didn't have the funds to pay all the creditors. Our only hope was to take the bank to court and demand our money back, as they should have protected our deposit, however we were worried about losing even more money if we didn't win the case.

Last year our friends David and Linda told us about Martín de la Herrán of Abolex, who had succeeded in recovering the money for many clients in a similar situation to us. We had been told that in Spain lawyers don't offer a "No win. No fee" contract to their clients, but when we contacted Martín and gave him all of our documentation, he was so confident that we would win our case that he offered to act for us on that basis. We couldn't believe our luck!

We have been impressed by the professionalism and persistence shown by Martín. There were a few delays along the way, but he kept us informed at every stage and showed a lot of patience when dealing with my impatience!

Thanks to Martín, we won our case and the bank has now returned our deposit, so this story has a happy ending.  If anyone else is in a similar situation, we can't recommend Martín highly enough.
