Case won against UNICAJA for a client that bought an off plan property from RODIGEST
More good news for one of our clients.
Last friday Court nr. 3 in Jerez de la Frontera notified us a Court judgement in favor of our client, who bought an off plan property in 2005 and paid 43,000 euros as deposit. It was a Ley 57/1968 action against UNICAJA bank.
The judgement confirms other previous judgements from the Spanish Supreme Court, as they were never given an individual bank guarantee, as stated in Law 57/68.
The First Instance Court found UNICAJA liable for refunding our clients deposit plus interest, according to its obligations under Article 1.2 of Law 57/1968, and sentenced the Bank to refund the full amount of the off-plan deposit plus legal interest from the date the buyers paid to the developer’s account. Legal costs of the First Instance procedure have also been awarded to our client.
So far, Abolex has been succesful in 100% of Law 57/68 claims due to the expertise of its director, Martin de la Herran.
